Clear Proof that a U7191 is locked, and VIN extraction

OK, I have been researching to find out if my Supposedly New U7191 is previously used and locked. The Tool Status is: "Tool is locked" , and the current Tune is Diablo. I believe this means the tool is locked to a VIN, and useless to me, as well as not being new. This means I will likely be purchasing a new Unit from an Authorized Dealer this week, but first I have 1 request, and one question:
Request:
Can a person representing DiabloSport Reply to this thread, and clearly state what the Tool Status of "Tool is locked" means, or any other methods to clearly determine that a U7191 Programmer is locked or has been previously used. This link can then be used as a reference in any disputes, as all I have found to date is passing references to this effect by other users.
Question:
Is their a method (potentially involving sending a file to DiabloSport) to extract the VIN that a Particular Unit is locked to. This would be of extreme benifit, and all I have found to date is a thread where someone sent in the file from the Tuner, and was given the VIN. This would be more than acceptable, and I would then request this service ASAP for my Tuner.

I dont represent DiabloSport Tech support but the information you are supplying clearly indicates that it is locked to another VIN. It will never accept your VIN unless you pay diablosport $129 to unlock the predator by phone. Once they unlock it, you will be able to install it in your vehicle.

If the tool is on rev 9r01 or higher, and you go to options/show last tune written. it will tell you the tune written to the car, and when you press continue, it will show you the a VIN and calid of the vehicle it is married to.

Unfortunately, it is an older revision (don't have exact number on me), so while it does say the Tool is locked, that Option to show last tune written / see the VIN does not exist. Today I will be getting a USB->Serial Cord, so I will upload the File(s) inside it, will that help to determine the status of the Unit?

It is locked, there is nothing to determine.

If you export a copy of the original tune stored in it, we can get the VIN number from that file.

I downloaded the Interface and the Instructions. I do not see a 'Custom Tune' option under the Options Menu, so I am having trouble uploading the File (particularly since the Diagnostics and Tune Menu's Fail with a comm error). I can provide some information from the Unit though, please advise if this sheds any light on how I might upload the file:
