intune says my car has already been tuned

2009 challenger rt

it says this ecu appears ti have been tuned before, backup not saved

and

failed to read pcm backup

so is the tune not saving?

how do i get the tune someone else put on the car off?

Either have the dealer flash the PCM, or call Tech Support on Monday and they'll talk you through it.

update the tool to the latest version, and it will simply prompt you to do a calibration update to go back to stock.
