Speed Limiter Appears to Reset Itself to "Yes"

Brand new T1000 for '12 Challenger R/T...installed the 91 performance tune and kept traction control "Yes" but the speed limiter keeps flopping back to "Yes" from "No." I don't want my speed governed as I have the appropriate tires for whatever my R/T can muster. Can this be corrected?

if you turn it of, its off, if you leave it on, its on, it does not change on its own....

Thanks...just thought it odd that when I selected "off" and then backed out of the selection that it still indicated "on." But I guess there is a way to check it.. :D
