I don't know what DEP is, but have you tried running as an administrator?
The apostrophe does not mean "Look out, here comes an S"!

"I couldn't care less" means it is impossible to care less - "I could care less" just makes you look stupid.

Are you running Win7 64?
Your allowing the VC++ 2005 redistributable to install?

The exception trace is showing a newer version of msvcrt.dll then the one with DV installer. Perhaps MSFT updated it for WIN7.
Post-up the file runtime.txt file found in "My Documents\DataViewer".

You can try re-downloading the vc++ 2005 runtime that's included in DV installer from here:
https://www.diablosport.com/beta/vcredist_x86.exe

But, this will require further investigation on Win7.

Well.. i have done that.. and the x64...

Ended up being adobe flash the culprit... MARK THIS!

I uninstall all adobe flash players and it started right up!

Now its not working again.. It looks like something is doing an update and it starts crashing again in the same module... I would love to get a fix for this once and for all...

Also, in Win7 try Control Panel->Programs->"Run programs made for previous versions of Windoze".

Select Dataviewer 3.3 from the list. It should indicate Win7 will attempt to run DV in Windows XP (Service pack 2) mode. IF it fails, run Program compatibility mode applet again.
