Bought A Predator That Was Said To Be Unlocked!!

well it happend to me, i always said when i bought a predator i would make sure it wasnt locked 100x. i know you guys preech about not buying used predators buit i got a pretty good deal on a used one so i couldnt resist. well i ended up buying a used predator from a member on ls1tech.com that told me the unit was unlocked and that he had restored the factory tune and made sure it said tune installed "factory tune".
when he sent it to me i plugged it in went through all the instructions and went to "tune it" mode. when i did this it said connecting then it stopped and said "tool is locked to another vehicale" http://img143.imageshack.us/img143/7310/1002312cb4.jpg

now i asked him why it said this because he clearly said this unit was unlocked in his thread. i callled diablosport and they said that if he found the recipt and filled out an RMA form they would unlock and update it for free. well i asked the seller if he could do that and he proceeded to say give him a day or 2 to see if he could find it.
on the 4th day still no response. so i decided to file a clam with paypal to get my money back. once he saw this he said he will not refund my money because he said he reinstalled the factory tune as instructed and its not his fault. diablo said i could send it in for $99 to be unlocked and updated but my question is how do i go about doing all this? its harware ver. 1.03 and system 1.00 or the other way around.
