Need help ASAP. Wont connect

Just ordered a supposedly "new" predator u7130. Hooked it up, it let me agree to terms and choose which tunes I wanted. When I choose performance tune it comes up with a message that says "can not connect to vehicle (1). Make sure ignition is on and vehicle is not running. Tried several times and keeps saying the same thing. My smarty works flawlessly. Any help would be appreciated
