can somebody turn my cat on if its not already on

Hey I got a dyno tune a few months ago. And I have to get an inspection sticker now and it failed for cat readiness. The last time I got it dynoed he did the same thing even though I asked him not to he turned the cat off. I think he did it again this time too. I dont have the cmr software so I cant even tell if he did shut it off.
